The K1 Experience

Ok for any keeping track. Date paperwork was received into the system was December 21st. Date petition was approved is March 21st. 3 months. Now first off I am rather happy that it has been done however what exactly has happend here? The papwerwork has been vetted but no visa has been approved. Nope, now we have the right to get one from the consulate. But first the paperwork has to go the the NVC. National Visa Processing center. Now out of curiosity... why didn't the inital request go to the national visa processing center? Ah well logic. Anyway now it will take 2-4 weeks for the NVC to receive our approved petition and to get us set up in their system before forwarding our request on to the consulate where the interview will be held. Why the processing of creating the visa case needs to be forwarded on to another center for more processing is something that baffles me. Well sometimes it is nice to expect the worst because occasionally you can then receive a pleasent surprise. The latest Update now has the california processing date for 129f forms at December 31st which is past our date of the 21st. So as long as all our paperwork is in order we should soon have our visa petition approved and can now actually apply for a visa at the consulate. Hopefully this means I can post a bit more information here on a more regular basis as the longest wait period for new information is by far waiting for your petetion paperwork to be looked at initially. The good news here is where we were expecting 4 months or more we had our paperwork off the shelf in about 2. Perhaps things are finally falling into place since the re-organization of the INS into the USCIS under homeland security. Course this is just the first step. Their are many to come. Hopefully all of them will come with similar nice surprise. Pardon me if I don't hold my breath. But I will enjoy this...

Dec 21 - Jan 24th, processing for the 129f K-1 processing at California - October 18th Most recent on Feburary 8th - November 3rd Progress at last. At this rate it may be to the Consulate sometime in April. Next update in a couple of weeks so we will find out if they maintain this pace of progress or if we go another three updates with no news. In other news we have decided to have our Wedding Ceremony overseas. However due to the nature of the k1 (that she has to be single when entering on it) The ceremony we have will not be a legally recognized marriage. We will still have to make a courthouse trip once she is in the country. Why you ask? Quite a few reasons, some due to the process some due to personal choices. We decided on the K1 because the process is faster. But turns out we want to hold the ceremony there. Well the USCIS California processing center seems to have taken the better part of a month off. At least as far as processing k1 visa requests. The second update in Janurary is out and as of the 24th they are still on the 18th of october. This Means we are 1 month in since our paper work was receieved... and no closer to having it looked at. Welcome to the world of Government paper work I suppose. Did I mention this was very frustrating ? Lets look at the other centers. Texas (supposedly the service center for my state) dosn't have a 129f processing date at all now. Nebraska is up to November 29th... I almost wish I hadn't looked at that one. Vermont, I take it back... I really didn't want to look at Vermont. They are on December 10th. Here is hoping they just forgot to update the California number... if anyone is still supposed to be going through Texas I hope they just left it off by accident. Well the first Update on the processing dates of the new year is out and they are unchanged. So from Dec 18th through Jan 6th the USCIS center in California (And Texas) made no apparent progress on 129f forms. They are still processing October 18th. I have seen this happen a few times before. One time three straight udpates (about a month and a half) saw the date remain the same for the Texas Center. One would think they managed to get at least a day or so of forms processessed in 19 days or so even if it was the holidays. Ah well... hopefully the next one will pick up the slack and advance it up into November.

Well we got a Xmas present from Uncle Sam and his Department of Homeland Security. We recieved our official notice of receipt of our paperwork. It was transfered to the California Processing center and our processing date is the 21st. All the processing centers seem to have gotten a decent bump and it looks like K1 processing is up to October 18th across the board. So our predicted date for approval of our petetion is now early march.

Why in gods name does the process of getting a fiance visa take so long? Well lets look at some numbers. USCIS Stat page 1st up. there are approximately 3 million pending claims for immigration to the US as of Sept 05. Approvals per month ranges between 400k and 600k. Received per month running a similar gamut. The inital brunt of this log is run through 4 processing centers. Texas, Nebraska, California, and Vermont. So evenly distributed this means the centers are processing somewhere between 100k and 150k forms a month. At that rate if you just worked on the back log it would take... about 6 months to work through 3 million cases. Surprise Surprise, that is about how long we expect it to take to get our K1. Its not exactly that simple of course. There are some 56 different visas and ascociated paperwork that these centers are dealing with. Some have backlogs dating back to '99. Yes you heard right. Ok. The package is in the mail. Mark it, day 1 of the official process. December 12. As of December 8th the current USCIS processing date for K-1 petitions at the center in Texas is August 3rd Petition should be received by thursday, the 15th. That puts us at a projected day for our petition to be processed in the latter half of April. Lets call it April 20th. Round 130 days or so away. Will post updates as the USCIS processing day times are updated and as we reach new milestones.

Ok, Forms all collected, Documents all collected. Time for the final check list. I-129F, Filled out, signed and dated. Check Additional items per instructions on back of I-129f -Passport style pictures of both of us taken withen last 30 days. Check -Names written on the back of said photos with felt pen. Check -Proof of US citizenship, Check (copy of birth certificate) I-129 states copies are acceptable. One of front and back. No request for original/certified copy. -Original Statement of Intent from both of us, Check -Filled out G-325a forms for both of us, Signed and Dated, Check -Additional evidence of relationship, meeting in person, Check -One Check in the amount of $170 made out to The Department of Homeland Security, Check. Double Checked, Check Triple Checked, Check Some additional stuff I added. -Copy front and back of my Drivers License, SS card. -Copy of Both of our Passports and Pass Port Stamps. My Forms, Documents, Evidence etc are all in slip covers arranged in a 3 ring ...

Ok, I had some questions regarding the instructions on the I-129f form, So I called the 1-800 number (1-800-375-5283) on the back of it and waded through the menus for a while looking for an option to talk to a person. Question number 1, regarding section 5b in the instructions for the I-129f which asks Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent; What Exactly is this? Can it be say a printed out E-mail? We live 4000 miles apart, I have to file the petition, getting a written statement of intent is not a simple, or fast process. Plus we are filing a $170 FIANCE visa petition of which the entire purpose is to obtain a visa so that she can enter the united states with the intent to marry me within 90 days. I am simply putting out what I have learned from various sources to document what our understanding is of the process in front of us. The K1 process is all about paperwork. For starters you need two pieces of paperwork. First The i129-f petition for alien fiance. This piece of paper is filled out buy the US citizen and filed with the appropriate USCIS center. The filing fee is $170 dollars. Second The G-325a biographic information supplement. Not to be confused with plain old G-325, or G-325b or G-325c. It is a requested suplement to go with i129-f. You need one for each person involved in the petetion. IE the requestor fills one out, the fiance fills one out, and the fiances children if required. Well I guess the process of getting a K1 visa always starts with a story. How do people from two different countries actually meet? Date? Fall in Love? Decide to get married? For us it all started typically enough. We met at the wedding of a mutual friend. I was a guest, she was the Maid of Honor. Circumstances were such that we got to spend a couple of weeks together and to say the least we hit it off. So well in fact that we decided that we should not let the fact we lived some 4000 miles apart keep us from persuing a relationship.
